Property Deposits

When purchasing a property via DCTS Real Estate Development LLC (Trading As Hurghada Apartment Sales) any holding deposit that is paid is Non Refundable unless other terms have been agreed and a contract made to change the above.

Governing Law

The terms and conditions of this website shall be governed by and construed in accordance with the laws of Arab Republic of Egypt. You consent to the exclusive jurisdiction of the Arab Republic of Egypt courts to resolve any legal matters arising from usage of this website, notwithstanding this, we reserve the right to bring legal proceedings in any competent court with jurisdiction or courts of your country of residence.

Terms and Conditions for Resale Apartment Sales

1. Introduction
   These terms and conditions (“Agreement”) outline the terms under which DCTS Real Estate LLC Egypt (“DCTS”) facilitates the sale of resale apartments in Hurghada, Egypt. By engaging in any transaction with DCTS, both the seller and buyer agree to abide by these terms.
2. Commission and Legal Fees
   Non-Refundable Deposit: Upon listing a resale apartment with DCTS, the seller agrees to pay a non-refundable deposit of 10% of the property’s sale price. This deposit serves as a commitment fee and covers administrative costs.
   Commission: Of the 10% deposit, 5% will be allocated as commission to DCTS for its services in marketing, negotiating, and facilitating the sale.
   Legal Fees: The remaining 5% of the deposit will cover legal fees associated with the transaction, including document preparation, title verification, and any necessary legal consultations.
3. Payment Structure
   Balance Payment: The buyer shall pay the remaining 90% of the property’s sale price upon signing the sales contract. This payment is due at the time of contract execution.
   The initial 10% deposit is considered a non-refundable payment to DCTS. It compensates the agency for its efforts, regardless of whether the sale is completed.
   Resale Properties Only: These terms apply exclusively to resale properties. DCTS does not handle transactions related to new properties with these terms and conditions.
4. Miscellaneous
   Property Disclosure: Sellers must provide accurate and complete information about the resale apartment, including any defects or issues.
   Contractual Obligations: Both parties shall fulfill their contractual obligations promptly and in good faith.
   Dispute Resolution: Any disputes arising from this Agreement shall be resolved amicably between DCTS and the buyer/seller or through legal channels as applicable under Egyptian law.
   By engaging in a resale apartment transaction with DCTS, all parties acknowledge and accept these terms and conditions.
